Brazilian Official ANATEL Released New Rules

Brazil's official ANATEL issued a public consultation No. 33 and is waiting for comments and suggestions from the public. It is estimated that resolutions 242 and 323 will be replaced by 90 days and will be implemented in 2018. The main contents are as follows:

(1) Alterations or Renewals of the Homologation Certificate will be charged by ANATEL;

(2) Market Surveillance will be carried out by ANATEL, which may or may not request the Certification Body to participate in this step of the process (the Agency will soon issue an operational procedure with further details);

(3) For renewal purposes, the OCD must only accept samples collected from the production line or available in the Brazilian market. The collection costs, whenever samples are collected in the Brazilian market, will be charged to the Certificate Holder in Brazil;

(4) Category III products will be subject to renewal in 60 months’ time (ANATEL will have to clarify the validity of the CoC for Category III products. It's not clear in the Public Consultation how they will handle it...);

(5) There will be some other changes which will impact the certificate holders directly(i.e. ANATEL renewal fee was not required before, but must be considered for new renewals; formal contracts authorizing the distributors in Brazil to use the Certificate Holder homologation ID must be uploaded on ANATEL website as well, etc.).
