MIC Vietnam: Draft Circular to replace Circular 42/2016/TT-BTTTT – New list of devices subjected to Type Approval and Declaration of Conformity

In the light of shortening the list of radio transmitters and transceivers subjected to MIC Type Approval, simplifying the procedures, and reduce total certification time for the products to enter Vietnam market, MIC Vietnam has released Draft Circular to replace existing Circular 42/2016/TT-BTTTT - Regulations on list of products subjected to MIC Type Approval and Declaration of Conformity. The new Circular is planned to take effect from 01 July 2018 together with several new National Technical Regulations introduced by MIC Vietnam recently.

Highlighted features:

1. Many radio devices (transmitters and transceivers) will be exempted from Type Approval (TA) certification, Declaration of Conformity (DoC) will be required still for a part of TA exempted products.

(1)Non-radio will be move from the list of product subjected to TA (Appendix I) to the list of product subjected to DoC (Appendix II).

(2)Radio devices using old technique are exempted.

(3)Short range devices having RF output power less than 60mW will be exempted from both Type Approval and Declaration of Conformity.

2. EMC requirements will be exempted from Type Approval certification but still required for Declaration of Conformity certification.

3. Products which is not named and listed with according National Technical Regulations (QCVN) will be exempted from TA certification but DoC could be required still. “Other equipment” category will be removed from Appendix I – List of products required Type Approval and Declaration of Conformity.

4. Reports issued by accredited over sea test lab (Non MRA) can be used for Type Approval certification for certain National Technical Regulations. ISO / IEC 17025 certificate of the test laboratory should be required accordingly.

5. Only item 2.6 - Safety requirements of QCVN 101:2016/BTTTT (equal to IEC 62133:2012) will be required for Lithium Battery during the lifetime of the new circular. Document No. 886/BTTTT-KHCN(official guidance for Circular 42) will be automatically invalid when the new circular enter in effect and local testing for lithium battery (applied for mobile phone, tablet, and notebook PC) will be required if there is no further guidance on Lithium Battery certification released by MIC Vietnam.

6. Total lead time to obtain Type Approval certificate can be shortened due to less requirements.

7. Vietnam HS Code is bound to each category.

8. Several new National Technical Regulations will enter in effect together with the new circular. QCVN 112:2016/BTTTT will replace QCVN 18:2014/BTTTT for WLAN devices.

Since Vietnam HS Code is now bound to each product category, Circular 18/2014/TT-BTTTT of MIC Vietnam shall need to be amended or renewed accordingly.
